1. Scope
These Terms and Conditions govern the use of this website and the remote session bass services offered by Antonio D'Amato (TonnoBass).
2. Service and booking
Services include bass recording, editing, and delivery of files as agreed per project. Booking requests are managed by email at book.com.
Project scope, deadline, pricing, and delivery format are confirmed case by case before work starts.
3. Pre-contract information
Before a booking is confirmed, the client receives clear pre-contract information by email, including: service scope, total price, payment terms, delivery timing, revision policy, and key technical requirements (for example BPM, references, and source material).
4. Prices, payments, and taxes
Unless otherwise agreed in writing, prices are expressed in USD. Payment method and timing are confirmed by email for each project. Any tax treatment (including VAT, where applicable) is clarified during confirmation.
A booking is considered confirmed once both scope and payment terms are accepted in writing.
5. Delivery timing and costs
Typical delivery timing is stated in the selected package or custom quote. Rush delivery, if requested and accepted, may carry additional cost. Digital delivery is made via agreed channels (for example WeTransfer, Dropbox, or Google Drive).
6. Revisions and refunds
- Short song and Premium song include 1 revision.
- Extra revisions are billed at each unless differently agreed in writing.
- If, after multiple revisions, no usable agreement is reached, a partial refund may be offered up to 50% of the total paid amount.
7. Right of withdrawal (consumers)
Where legally applicable, consumers may have a 14-day withdrawal right for distance contracts under EU/Italian consumer law.
However, for personalized creative services, withdrawal may be excluded or lost once performance has started with the client's prior express request/consent, or once the service has been fully performed, as permitted by applicable law (including exceptions under Article 59 of the Italian Consumer Code).
Before starting work, TonnoBass may request an explicit written confirmation by email that the client asks to begin the personalized service.
8. Delivery and client responsibilities
The client is responsible for providing complete project material (reference track, BPM, session/demo link, notes, and deadline). Missing or unclear information may affect delivery time and final result.
9. Intellectual property
Unless otherwise agreed in writing, the client receives usage rights for the delivered bass recordings for the intended project. TonnoBass retains ownership of website content, branding, and non-delivered proprietary materials.
10. Legal guarantee of conformity
The 2-year legal guarantee of conformity typically applies to consumer goods. TonnoBass mainly provides custom creative services, so legal protections are applied according to the actual contract type and mandatory law.
11. Limitation of liability
To the maximum extent permitted by law, TonnoBass is not liable for indirect damages, loss of profit, data loss, platform outages, or third-party service interruptions. Liability for direct damages is limited to the amount paid for the specific project concerned.
12. Website use rules
Users may not misuse this website, attempt unauthorized access, interfere with availability, or copy/reuse website content in violation of applicable intellectual property laws.
13. Applicable law and jurisdiction
These Terms are governed by Italian law. Any dispute that cannot be settled amicably is subject to the Court of Milan (Foro di Milano), unless mandatory consumer protection rules provide otherwise.
